Terms and Conditions for the Provision of Services via the Online Store Operated by Natural Healing Center Bartosz Filapek
Preliminary Provisions
The online store available at www.healthyveganfamily.com (hereinafter the „Online Store”) is operated by the company Natural Healing Center (hereinafter the „Seller”), registered at ul. Drzymały 19, 43-502 Czechowice-Dziedzice, Poland, with Tax ID (NIP): 652-167-17-40 and REGON: 240496009. These Terms and Conditions specify the procedures, rules, and conditions of the Seller’s remote sale of e-books and courses via the Online Store. Use of various sales options for e-books is subject to the functionalities available within the Online Store. Orders in the Online Store may be placed by: a) an adult natural person with full legal capacity, purchasing Juices for purposes not directly related to their business or professional activity; b) an adult natural person with full legal capacity, conducting business activity, a legal entity, or an organizational unit without legal personality but granted legal capacity by law, purchasing Juices for purposes directly related to their business or professional activity; hereinafter collectively referred to as the „Client.” These Terms and Conditions are based on the generally applicable laws of Poland. Conditions for Placing Orders Electronically
To place an order in the Online Store, you must use an IT system that meets the following minimum technical requirements: a PC or any other device with Internet access and a web browser that correctly supports HTML 5. Additionally, the browser must have JavaScript enabled and allow cookies. An active email account is required to place an order. An order may be placed via a personalized panel created for each Client by the Seller after the Client completes the actions outlined in section 3 below, or via an order form without the need to create a Client Account. Creating a Client Account involves completing and submitting an electronic form available within the Online Store or logging into the Client’s Facebook account. Completion of the Registration Form includes, in particular, providing an email address and creating a username and password, along with accepting the Terms and Conditions. The Client is responsible for the accuracy of the data provided in the Registration Form. Creating a Client Account or logging in via Facebook signifies the Client’s intention to enter into an electronic service agreement. Without this consent, a Client Account cannot be created. By registering or placing an order, the Client confirms they have read, accept, and agree to comply with these Terms and Conditions.
Steps in the Contract Conclusion Procedure
For Clients with an Account: a) subject to sections 3–5 below, selecting products from the Store’s assortment, b) logging into their Account, c) choosing the delivery method and address, as well as providing billing information, d) selecting the payment method, e) submitting the order by clicking „Order and Pay”, f) making the payment, g) receiving the ordered products.
For Clients without an Account: a) selecting products, b) providing necessary personal details (name, email, phone), c) specifying delivery and invoice information, d) selecting payment method, e) submitting the order, f) making the payment, g) receiving the products.
During the ordering process, the Client confirms they have read and accepted the Terms. All form fields must be completed unless marked optional. Clients are responsible for the accuracy of the data provided. Orders are accepted 24/7 throughout the year. After placing an order, the Client receives an email confirmation with all key order details. The sales contract is concluded upon receipt of this confirmation email. The Client may modify or cancel the order before it is dispatched by emailing naturalveganhealing@gmail.com. The order is modified/canceled once the Seller confirms the change. A receipt or VAT invoice is sent electronically to the email provided by the Client. The Client consents to receive these documents electronically. All product information in the Online Store (descriptions, ingredients, prices) constitutes an invitation to treat under Polish Civil Code Article 71 and is not a binding offer.
Prices
Prices listed on the Online Store are binding at the time of order submission. All prices are in PLN and include VAT. Delivery costs are added to the total and borne by the Client. Total price, including delivery, is shown in the order summary and accepted by clicking „Order and Pay.” The Online Store may change product prices, introduce new products or promotions, and withdraw them in accordance with applicable law. Changes do not affect contracts concluded before the change. Prices may vary for different Clients due to individual agreements or discount policies.
Payment Methods and Order Processing
Clients must pay in full before the order is processed. Payment must be made via electronic transfer or payment card through systems accepted by the Seller (e.g., Stripe, PayPal). Order processing begins after confirmation from the payment provider. Payment conditions are defined by the respective online payment operators.
Delivery Conditions
Digital products are delivered to the email address provided in the order.
Complaints
The Seller must deliver defect-free products and is liable under statutory warranty for defects. Consumers are entitled to remedies including defect removal, replacement, price reduction, or withdrawal from the contract (if the defect is significant). Warranty rights apply only to consumers. Complaints may be submitted via email to: naturalveganhealing@gmail.com and should include name, order number, description of the issue, and proof of purchase. The Seller will respond within 14 calendar days via email or mail. If accepted, the corrected product will be delivered. Consumers may pursue unresolved claims through courts or out-of-court mechanisms, including mediation or arbitration via UOKiK (http://www.uokik.gov.pl/download.php?plik=6223 and http://www.uokik.gov.pl/wazne_adresy.php#faq596). They may also use the EU ODR platform (http://ec.europa.eu/consumers/odr/).
Right of Withdrawal
Consumers may withdraw from the contract if the digital product is not delivered. Per Article 38 point 13 of the Consumer Rights Act (30 May 2014), no right of withdrawal applies if the consumer consented to immediate delivery of a non-physical digital product and acknowledged the waiver of withdrawal rights. By purchasing, the consumer waives the right to return digital products unless they contain irremediable defects.
Electronic Service Provision
The Seller also acts as the service provider of electronic services as defined by the Act of 18 July 2002 on electronic services. By using or agreeing to the Terms, the Client enters into an electronic services agreement. The Seller provides access to an application for account creation and ordering via the Online Store. Clients must use devices and software meeting specified technical requirements. The Seller ensures data security via encryption and access controls. Interruptions for maintenance may be communicated via email or website. Clients must not: submit unlawful content; disrupt the Store; or act contrary to social norms or public decency. Clients may withdraw consent to use electronic services at any time. Service complaints follow the same procedure and timeframes as product complaints.
Personal Data
The Seller is the controller of Clients’ personal data. Contact: naturalveganhealing@gmail.com or ul. Drzymały 19, 43-502 Czechowice-Dziedzice, Poland. Data is protected in accordance with GDPR (EU Regulation 2016/679). Personal data is collected based on the Client’s chosen order method and is necessary to fulfill the contract and services. Data may include: name, address, email, phone, fax, tax ID, login credentials. Provision of data is voluntary but required for order fulfillment and services. Purposes: order fulfillment, electronic services, analytics, legal compliance, direct marketing, etc. Data may be shared with subcontractors, including delivery and IT service providers. Data is retained per legal requirements and business needs. Clients have the right to access, rectify, delete, limit processing, transfer data, object to processing, and file complaints with data protection authorities. Data may be processed automatically, including profiling, to optimize content and marketing but not for automated decision-making. Data may be transferred outside the EEA with appropriate safeguards.
Cookies
The Seller uses cookies to improve service quality and gather statistics. Types: session cookies (active while browsing) and persistent cookies (stored on the device). Clients can configure browsers to reject cookies, but this may affect functionality. Using a browser that accepts cookies implies consent to their use. Cookies support: session management, usage statistics, user profiling for targeted ads, and Store optimization.
Amendments to the Terms and Conditions
The Terms may change due to legal, technical, or organizational reasons. Clients will be notified at least 14 days in advance via website and email (for Account holders). Clients may terminate the agreement within 14 days of notification. Termination equals account deletion and data removal. Lack of termination within 14 days implies acceptance of the new Terms, subject to confirmation during next login. Orders placed before changes are governed by the prior Terms.
Final Provisions
The Seller is not liable for errors due to incorrect data provided by the Client or unauthorized use of login credentials. Polish law governs matters not covered by these Terms. The Consumer Rights Act of 30 May 2014 applies. These Terms and Conditions are effective from 05.06.2020.
